By accessing or using Ofinis (“Service”, “we”, “us”), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service. We may update these Terms from time to time; continued use constitutes acceptance.

2. Eligibility

You must be at least 13 years old to use Ofinis. By using the Service you represent that you meet this requirement and, if using on behalf of an organisation, that you have authority to bind that organisation to these Terms.

3. Description of Service

Ofinis provides an AI-powered chat assistant and developer API. Responses are generated by large language models and may be inaccurate, incomplete, or out-of-date. You should independently verify any information before relying on it for important decisions.

4. Account Registration

You may use the Service as a guest without creating an account, subject to guest usage limits. Registered accounts require a valid email address and a secure password. You are responsible for maintaining the confidentiality of your credentials and all activity under your account.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is unlawful, harmful, threatening, abusive, or harassing;
• Produce or distribute malware, spam, or other malicious code;
• Infringe the intellectual property rights of any third party;
• Impersonate any person or entity;
• Engage in automated abuse, scraping, or denial-of-service attacks;
• Violate any applicable local, national, or international law.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

6. API Usage & Rate Limits

API access is subject to the rate limits and quotas associated with your plan. Attempting to circumvent rate limits, sharing API keys publicly, or reselling API access without written permission is prohibited.

7. Intellectual Property

The Ofinis name, logo, and platform are our intellectual property. You retain ownership of the content you submit. By submitting content you grant us a limited, non-exclusive, royalty-free licence to process it solely to provide the Service. We do not use your conversations to train our models without explicit consent.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated outputs will be accurate or complete.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Ofinis and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service, even if advised of the possibility of such damages.

10. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may delete your account at any time by contacting us at support@ofinis.com.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Ofinis is registered, without regard to conflict of law provisions.
